Neha Bora Peace Bond Case : The dispute between AISA national president Neha Bora and the administration over protests in Delhi has intensified. Even after the Delhi High Court dismissed her petition, Neha has refused to sign a peace bond. She argues that the bond could affect her constitutional rights. She has alleged that such measures could be used to prevent people from participating in peaceful demonstrations. Neha has made it clear that she will not sign the bond and that no AISA member will sign it either.
Notice Issued Following Protests Against Chief Election Commissioner
The case is connected to protests held against Chief Election Commissioner Gyanesh Kumar. Neha Bora was issued a notice by the Special Executive Magistrate (SEM) because of her active participation in these demonstrations. The notice directed her to sign a peace bond. Neha subsequently approached the Delhi High Court, seeking a stay on the notice. However, the court dismissed her petition. Despite the setback, she has maintained her position and continues to refuse to sign the bond.
Why the Delhi High Court Dismissed Her Petition
Neha Bora filed her petition before the Delhi High Court on October 17. On October 23, the court declined to intervene in the matter. During the hearing, Justice Subramonium Prasad observed that the SEM had sufficient grounds to initiate proceedings against Neha. According to the court, the notice was not based solely on hearsay. The SEM had considered the relevant facts and circumstances before making the decision. On this basis, the court declined to grant her request for a stay on the notice.
Court Examines Concerns Over Possible Public Disorder
During the hearing, the court was also informed about the area where Neha had been detained. She was accused of urging people in the area to participate in the protest. It was argued before the court that the location was a commercial area with heavy footfall from office workers. Several important roads also pass through the area, connecting central parts of the city with other neighbourhoods. Considering these circumstances, the SEM had expressed concerns about the possibility of a breach of public peace.
Neha Cites Constitutional Rights to Protest Peacefully
Neha Bora maintains that signing the peace bond could restrict her constitutional rights. She believes peaceful protest is a right of citizens and that such bonds should not be used to prevent people from demonstrating. She has also stated that she will stand by this decision alongside all AISA members rather than act alone. Despite failing to obtain relief from the High Court, Neha has reiterated her refusal to sign the bond.
Peace Bond Dispute Takes Political Turn
The dispute between Neha Bora and the administration has become part of a broader debate over the right to peaceful protest and the maintenance of law and order. Questions have been raised about the administration’s action, while the High Court has declined to intervene in the SEM’s notice. Neha has announced that she will not sign the bond. Attention is now focused on what steps may follow in the case. For now, the central issues remain the conditions of the peace bond and Neha’s objections concerning the right to peaceful protest.
